Terms of Service

These terms govern your use of convertmarketing.com.ng and the free website diagnostic we offer through it. Please read them before you use the site or book a call. If you do not agree with them, please do not use the site.

Paid work we do for clients is governed by a separate written agreement, not by these terms. Where the two disagree, that agreement wins.

In these terms, “we”, “us” and “our” mean Convert Marketing. “You” means the person or business using this site.

2. Accepting these terms

By browsing this site, submitting a form on it, or booking a diagnostic call, you accept these terms. If you are agreeing on behalf of a company, you confirm that you are authorised to do so.

You must be at least 18 years old to use this site or book a call.

3. What this site is for

This site describes what we do, shows examples of our work, and lets you book a free website diagnostic. Everything published here is general information about marketing, websites and lead generation. It is not professional, legal, financial or tax advice, and you should not treat it as a substitute for advice about your own situation.

4. The free website diagnostic

The diagnostic is a short review of your website and how people currently find and contact you, delivered on a call of roughly fifteen minutes.

• It is free and carries no obligation to buy anything from us.
• By giving us your website address you confirm that you own or are authorised to act for that website, and you give us permission to view its public pages, run the standard research tools we use, and look at what appears about it in search engines and public directories.
• We choose which bookings we accept. We may decline or reschedule a booking, and we may end a call early if it is being used for something other than a genuine review.
• Please tell us if you cannot make your slot. If nobody joins within ten minutes of the start time we treat the booking as cancelled, though you are welcome to book again.
• Anything we tell you in the diagnostic is our opinion based on what we can see at the time. Acting on it is your decision, and we cannot promise any particular outcome such as more traffic, more enquiries, higher rankings or more revenue.

5. Paid work

If we go on to work together, the scope, fees, timelines, deliverables and ownership of the work are set out in a separate proposal or agreement that we both sign. Nothing on this site is an offer to enter into a contract, and no contract exists between us until that agreement is in place.

6. Information you give us

Please give us accurate information when you fill in a form. We rely on it to prepare for your call and to reach you afterwards.

We handle personal information as described in our Privacy Policy. Do not send us financial account details, government identification numbers, health information or anyone else’s personal information through this site.

7. Acceptable use

You agree not to:

• submit false, misleading or automated form entries, or book slots you have no intention of attending
• use the site to send spam, malware or anything unlawful
• attempt to gain unauthorised access to the site, its server or its database
• scrape, copy or republish substantial parts of the site without our written permission
• use the site in a way that damages it, interrupts it, or interferes with anyone else’s use of it

We may suspend or block access to the site, and refuse or cancel a booking, if we reasonably believe any of this is happening.

8. Our content

The text, design, graphics, logos, case studies and other material on this site belong to us or to our licensors and are protected by copyright and trade mark law. You may view the site and print or download extracts for your own reference. You may not reproduce, publish, sell or otherwise exploit any part of it commercially without our written permission.

The Convert name and logo are ours. Other names and logos on the site belong to their owners and are used to identify their products and services.

9. Your content

Anything you send us stays yours. By sending it you give us permission to use it for the purpose you sent it for, such as preparing and delivering your diagnostic. If we would like to use your name, logo or results as a case study, we will ask you first.

10. Availability of the site

We try to keep the site available and accurate, but we do not promise that it will always be online, error free, or free of viruses. We may change, suspend or withdraw any part of it, including the diagnostic offer, at any time and without notice.

11. Other websites and services

This site links to other websites and uses third party services such as Google and Meta. We do not control them and we are not responsible for their content, their availability or how they handle your information. Their own terms and policies apply when you use them.

12. Our liability

The site and the free diagnostic are provided on an “as is” basis. To the fullest extent the law allows, we exclude all warranties, conditions and representations that are not expressly set out in these terms.

We are not liable for indirect or consequential loss, or for lost profits, lost revenue, lost business, lost data or lost goodwill, arising from your use of this site or from anything discussed on a free diagnostic call. Where we are found liable for anything connected with the free diagnostic or your use of this site, our total liability is limited to fifty thousand naira (₦50,000).

Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

13. Marketing emails

If you book a call or contact us, we may send you occasional emails about our services. Every one of them carries an unsubscribe link, and you can opt out at any time by using it or by emailing hello@convertmarketing.com.ng.

14. Changes to these terms

We may update these terms as our services and the law change. The date at the top shows when they were last revised, and the version published here at the time you use the site is the one that applies.

15. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from them or from your use of this site is subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria. Before starting proceedings, please contact us so that we can try to resolve the matter directly.

16. General

If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, that does not mean we have given it up. These terms are between you and us; nobody else can enforce them.
